Marriage Application Requirement Massachusetts: Get Copy Of Birth Certificate

The following information outlines the procedures you must follow to obtain the license.

  • Both persons must apply must apply in person, together and at the same time for a marriage license.

  • If a person is in the military, intentions may be filed by either party, provided one is a Massachusetts resident.

  • In the case of same-sex marriages, both parties must be residents of Massachusetts or show documentation that satisfies the City/Town Clerk that they intend to reside in Massachusetts after being married.

  • Both parties must show valid government-issued photo ID (driver’s license, state ID, or passport).

  • Both parties must know their Social Security numbers to complete their Marriage Intention Form.

You do not have to be a state resident to get married in Massachusetts, but you must obtain a valid marriage license issued by a Massachusetts City/Town Clerk. An out-of-state marriage license cannot be used.

Marriage Waiting Period Requirement Massachusetts:

Yes, there is a mandatory (3) three day waiting period. While Sundays and holidays are included in the three days, the day the application is made is not. For example, if you apply on Friday, your license will be issued on or after Monday. Check with the City/Town Clerk in the city or town in which you intend to file your intentions whether you must pick it up in person, or if it can be mailed.

Court Waiver Requirement Massachusetts:

If you and your prospective spouse must marry before the 72 hour waiting period is over, you can seek to have the waiting period waived by filing a request for a Marriage without Delay  Marriage License, State of Massachusetts Marriage License, MA with the probate court or district court in the city or town, or county where you originally applied for the license. If either person was previously married, joined in a civil union, a registered domestic partnership, or other legally binding relationship recognized by another state, this relationship must be legally dissolved (meaning your divorce must be final) before applying for a Massachusetts marriage license.
