When applying for your marriage license in Manhattan, you will need to bring several items with you, the most important of which is identification. You need both a photo ID and a document that provides proof of age. If you under the age of 18, you will also need to have both of your parents present when applying, and they will need photo ID as well. Anyone under 16 years of age will need the written approval of a judge in addition to parental consent.

New York accepts eight forms of identification. Be sure your identification is current and valid.

Driver’s License with photograph (from the United States of America or any of its territories)
Non-Driver Identification Card with photograph (from the United States of America or any of its territories)
Learner’s Permit with photograph (from the United States of America or any of its territories)
Active United States Military Identification Card
Passport
United States Certificate of Naturalization (good for 10 years after date of issue)
United States Permanent Resident Card
United States Employment Authorization Card

To establish proof of age, you will need to submit one of the following age-related documents to the issuing clerk:

Birth Certificate
Baptismal record
Naturalization record
Census record

If you are unsure of what documents you need, you can always contact the local Clerk’s Office before you go. It is a good idea to verify the days and hours a Clerk is available before you go. You can also ask what types of payment they accept for the $35 marriage license fee.

When applying, you will also need to provide documentation of all previous marriages. This includes your previous spouse’s full name; the date the divorce decree was granted; and the city, state, and country where the divorce was issued. You will also be required to show a certified copy of the divorce decree or death certificate. All divorces, annulments, and dissolutions must be finalized before you apply for a new Manhattan marriage license.

You do not have to be a resident of New York to obtain a Manhattan marriage license, but proxy marriages are not permitted, which means you and your future spouse must appear in person to apply for your marriage license. There is also a 24-hour waiting period after the license is issued before the ceremony can be performed. If you and your prospective spouse must marry before the 24-hour waiting period is over, you can request a Judicial Waiver from the County Clerk in the county or borough where you obtained your marriage license.
