Marriage Application Requirement Colorado: Get Copy Of Birth Certificate

To complete the application for a marriage license, a couple must:

  • Both applicants must appear in person to apply and sign the marriage application.
  • If one party cannot appear due to illness, because he/she is out-of-state state, or incarcerated, the party applying must bring the absentee application along with identification for the absent party. The absentee application form must be notarized in advance.
  • $30 Cash for Marriage License Fee.
  • Identification for Proof of Age: Such as a Driver’s License issued in the United States, Passport, Military ID, or State-issued ID Card.
  • Social Security Number: If either party does not have a social security number, they must sign an affidavit provided by the County Clerk’s office when applying for the license.
  • Place of Birth (City and State) must be listed on the application form.
  • Parents’ Names and Current Addresses must be listed on the application form.

  • Applicants 15 years of age or younger must obtain a court order granting judicial approval as well as complying with the above requirements. The court order must be obtained in the county where judicial approval has been granted.

 

Marriage Officiants Colorado:

14-2-109. Solemnization and registration.

(1) A marriage may be solemnized by a judge of a court, by a court magistrate, by a retired judge of a court, by a public official whose powers include solemnization of marriages, by the parties to the marriage, or in accordance with any mode of solemnization recognized by any religious denomination or Indian nation or tribe.

Either the person solemnizing the marriage or, if no individual acting alone solemnized the marriage, a party to the marriage shall complete the marriage certificate form and forward it to the county clerk and recorder within sixty days after the solemnization.

Any person who fails to forward the marriage certificate to the county clerk and recorder as required by this section shall be required to pay a late fee in an amount of not less than twenty dollars. An additional five-dollar late fee may be assessed for each additional day of failure to comply with the forwarding requirements of this subsection (1) up to a maximum of fifty dollars.

For purposes of determining whether a late fee shall be assessed pursuant to this subsection (1), the date of forwarding shall be deemed to be the date of postmark.

Couples themselves may solemnize their own marriage (C.R.S. 14-2-109). Others who can solemnize a marriage are judges, retired judges, magistrates, Indian tribe officials and clergy. Although the couple may solemnize their own marriage, that does not mean a friend or relative can sign as an officiant on a marriage certificate.
