All persons who intend to get married in New York State must obtain a marriage license. For more information about marriage license laws and regulations in New York State, please visit the New York State Department of Health, Vital Records Section.
Fees in Binghamton:
The fee for a marriage license issued in New York State is $40, payable by cash, money order or local bank check payable to the Binghamton City Clerk. No credit or debit cards are accepted in the City Clerk’s Office.
Duration
of the Marriage License:
Marriage
licenses are valid for sixty (60) days. A marriage license issued in
Binghamton can be used anywhere within New York State, but may not be
used outside of New York State.
Application
Procedure:
Listed
below are the general steps and rules of the application process.
You and your prospective spouse must appear together in person to apply for a marriage license.
Proxy marriage is not permitted in Binghamton, so no other party may apply on behalf of either party.
You can either fill out an application form in the City Clerk’s Office, or you may print out a copy of the form found on the City of Binghamton website.
Your marriage license will be processed while you wait.
You should carefully read your marriage license to make sure there are no mistakes.
You will take the marriage license with you when you leave the Binghamton City Clerk’s Office.
You must wait a full twenty-four (24) hours before your marriage ceremony can be performed, unless you obtain a Judicial Waiver.

below is the information you will need to fill out the marriage
license application:
Both bride and groom must provide their name; current address; city, state, ZIP code and country; country of birth; date of birth; name and country of birth for both father and mother; Social Security Number; and marital history.
When you sign the affidavit, you are making a sworn statement that there are no legal impediments to the marriage.
If you were married before, you must list all prior marriages. You must include your previous spouse's full name; the date the divorce decree was granted; and the city, state, and country where the divorce was issued.
All divorces, annulments, and dissolutions must be finalized before you apply for a new Marriage License.
Any and all records of previous marriages must be provided at the time of application, including final divorce decrees and death certificates.
Proof
of Age and Identity:
You
and your prospective spouse must have proper identification in order
to apply for a marriage license. This includes at least one valid
form of proof of age, and
one valid form of proof of identity, outlined below:

Driver's license
Passport
Employment picture ID
Immigration record
Please note that all foreign birth documentation and baptismal (church) records must be accompanied by a certified translation from a certified translator. A certified translator can be found at a local university or the Consulate of the applicant’s country.
Blood Test Not Required:
A blood test is not required to obtain a marriage license in Binghamton.
Residency Requirement:
You do not have to be a resident of Binghamton, NY in order to obtain a marriage license from this municipality.
Proxy Marriages:
Proxy marriages are not allowed in New York State.
Cousin Marriages:
Cousins are allowed to marry each other in New York State.
Common Law Marriages:
Common law marriages are not recognized by New York State.
Same-Sex Marriages:
Licenses for same-sex marriages are not issued in New York State.
Name Change Options:
Whether you wish to change your surname or keep it the same, you will need to state your desired choice on the marriage license application. Various surname options are listed on the back of the application.
You must state your choice of surname on the application. If you elect to make a surname change on your application, the surname change takes legal effect at the conclusion of the marriage ceremony.
The name change option does not apply to your first name or middle name.
If you wish to change your surname through the Binghamton City Clerk’s Office after your marriage ceremony, you may do so through a “second ceremony”.
Although you may correct mistakes in your Certificate of Marriage Registration, a surname choice is not considered a mistake and cannot be changed through the amendment process.
Duplicate Marriage License:
If the marriage license is lost, stolen, or damaged, you must obtain a duplicate marriage license in order to get married.
The fee for a duplicate marriage license is $10, payable by cash, money order, or local bank check payable to the Binghamton City Clerk.
A couple may apply for a duplicate marriage license by returning to the office that issued the original marriage license and completing a duplicate marriage license application. All original documentation will be required for review.
Under the Age of Eighteen:
If either you or your prospective spouse is under 18 years of age, please note the following:
If either applicant is under 14 years of age, a marriage license cannot be issued.
If either applicant is 14 or 15 years of age, such applicant(s) must present the written consent of both parents and a justice of the Supreme Court or a judge of the Family Court having jurisdiction over the town or city clerk in which the application is made.
If either applicant is 16 or 17 years of age, such applicant(s) must present the written consent of both parents.
If both applicants are 18 years of age or older, no consents are required.
One parent alone may consent to a minor's marriage if:
The other parent has been missing for one year preceding the application;
The parents are divorced and the consenting parent was given sole custody of the child when the divorce decree was awarded;
The other parent has been judged incompetent; or the other parent is deceased.
Parents, guardians or other people consenting to the marriage of a minor must personally appear and acknowledge or execute their consent before the town or city clerk or some other authorized official. If the notarized affidavit is made before an official outside of the State of New York, it must be accompanied by a certificate of authentication when the consent is filed in New York State.
Although the marriage license is issued immediately, the marriage ceremony may not take place within 24 hours from the exact time that the license was issued. When both applicants are 16 years of age or older, the 24-hour waiting period may be waived by an order of a justice of the Supreme Court or a judge of the County Court of the county in which either the bride or groom resides. If either person is under 16 years of age, the order must be from the Family Court judge of the county in which the person under 16 years of age resides.
Officiants in Binghamton, NY:
According to Section 11 of the Domestic Relations Law, an officiant must be an authorized, officially ordained member of the clergy or a public official in the State of New York such as the Mayor, City Clerk, Deputy City Clerk, appointed marriage officer, justice, or judge. The Binghamton City Clerk’s Office performs marriage ceremonies by appointment only. The cost of a ceremony taking place during regular business hours is $40. Ceremonies outside of regular business hours may be performed by the City Clerk within the City of Binghamton at a cost of $100, by appointment only. Witnesses:
A
marriage ceremony must have at least one witness. Binghamton requires
witnesses to be at least 18 years of age.
Marriage
Certificates:
A marriage license is the document which proves that the bride and groom have the legal ability to get married. A marriage certificate is the document which proves that the bride and groom are married. A marriage certificate is issued after the license is completed by the Marriage Officiant. The Officiant will mail the completed license to the Binghamton City Clerk’s Office after the ceremony. A certificate will be mailed directly to the bride and groom, or the bride and groom may pick up their marriage certificate in person.

The New York State Department of Health does not file and cannot issue copies of marriage
certificates for persons who obtained the marriage license in New York City. For marriage
licenses issued in one of the five (5) boroughs of New York City (Manhattan, Kings, Queens,
the Bronx, and Staten Island), please visit the
New York City Marriage Bureau web page. Please note that the borough of Kings is also
referred to as Brooklyn and the borough of Staten Island is also referred to as Richmond.
